The family of Samuel B. Cunningham, a previous resident of Lexington Medical Center Extended Care, was awarded $450,000 in a recent wrongful death case against the nursing home for gross negligence. Cunningham was a resident at the facility, where he allegedly fell more than 20 times before he was hospitalized for serious medical conditions, which ultimately cost him his life.
Cunningham entered the Lexington Medical Center Extended Care facility in April of 2013 at the age of 81. He was blind and also suffered from dementia.
The nursing home’s records show that Cunningham fell a total of 26 times while in their care. After one fall, Cunningham was found outside of the facility, on the ground, with several ant bites. Another fall resulted in a hip injury, which required a hip replacement surgery. For medical care, Mr. Cunningham was treated at the Lexington Medical Center, which is in charge of the nursing home facility he resided in.
On July 1, 2015, Cunningham was taken to the Lexington Medical Center for skin breakdown, malnutrition, dehydration, and infections. After two weeks, he succumbed to his injuries.

Cunningham’s family was awarded a total of $450,000, $200,000 of which is for Cunningham’s pain and suffering, medical expenses, and funeral expenses. The remaining $250,000 was awarded for the family’s shock, suffering, and loss of companionship.
